This policy applies to photography products, digital images and other personalised items ordered directly from Louise Ferguson Photography, including orders paid for using PayItMonthly finance.
Photography products are created specifically for each client using their chosen images, specifications and personal preferences. These may include albums, frames, wall art, prints, folio boxes and other personalised products.
Once you approve and place your order, you are entering into a binding contract to purchase the selected products.
Please check your order carefully before confirming it. Changes cannot normally be made once production has started.
Please contact Louise Ferguson Photography immediately if you wish to cancel or change your order.
Where production has not yet started, we will consider whether the order can be cancelled. We may retain or charge an amount that reasonably reflects the work completed, costs incurred and losses resulting from the cancellation.
Once a personalised product has entered production, it cannot normally be cancelled, returned or exchanged simply because you have changed your mind. You will remain responsible for paying the agreed price for the order.
This does not affect your legal rights where a product is faulty, damaged, incorrectly supplied or does not match the agreed description.
Digital images are created and prepared specifically for you.
Once digital images have been supplied, downloaded or otherwise made available to you, they cannot be returned. Payments for digital images are therefore non-refundable once delivery has taken place.
This does not affect your legal rights where digital content is faulty, cannot be accessed or does not match what was agreed.
PayItMonthly may be offered in person as a payment option for eligible bespoke product orders. It is not available through the Louise Ferguson Photography online checkout.
Your agreement to purchase products from Louise Ferguson Photography and your finance agreement with PayItMonthly are separate agreements.
You have a statutory right to withdraw from your PayItMonthly finance agreement within 14 days. Withdrawing from the finance agreement does not automatically cancel your product order or remove your responsibility to pay for it.
If you withdraw from the PayItMonthly agreement but your order remains valid, you must either:
repay the amount borrowed to PayItMonthly in accordance with its instructions; or
arrange an alternative payment method with Louise Ferguson Photography, where agreed.
Where Louise Ferguson Photography agrees to cancel an order or accept the return of a product in accordance with this policy, any applicable settlement with PayItMonthly will be arranged.
Questions about withdrawing from or managing your finance agreement should be directed to PayItMonthly.
Payments made through PayItMonthly are governed by your finance agreement with PayItMonthly.
Cancelling a photography session, changing your mind about the products or choosing not to collect your order does not automatically cancel the product order or the associated finance agreement.
You should contact PayItMonthly promptly if you are experiencing difficulty making your repayments.
Please inspect your products as soon as reasonably possible after receiving them.
Contact Louise Ferguson Photography if a product arrives damaged, is faulty or does not match your confirmed order. Please include photographs and details of the issue where possible.
The issue will be assessed and an appropriate remedy provided in accordance with your statutory rights. Depending on the circumstances, this may include repair, replacement or a refund.
Failure to collect a completed product, refusal to accept delivery or failure to provide information needed to complete the order does not cancel the order or remove your obligation to pay the outstanding balance.
Louise Ferguson Photography may charge reasonable additional costs resulting from repeated delivery attempts, storage or changes requested after the order has been confirmed.
